The legal framework for foreign ownership of real
estate in Morocco

Morocco has recently witnessed a great demand by foreigners for real estate, desiring them to

own real estate in Morocco, for several reasons, including what is related to the economic aspect

and the low standard of living in Morocco compared to some European countries, and there is also something related to the security aspect, as Morocco provides stability In terms of security, it stimulates and encourages investment compared to some countries located in the middle of the

African continent. There is also the legal aspect, as Morocco provides a legal arsenal that provides foreigners with the possibility of investing their money inside the Kingdom of Morocco, which allows them to enjoy and benefit from a set of rights.

  • Can foreigners own some real estate inside Morocco?

 

The amended Constitution of the Kingdom of Morocco in 2011 in (Chapter 35) and according to the laws in force stipulated the principle of freedom to own real estate through the following text:

“The law guarantees the right to property. Its scope and practice can be limited by law, if required by the requirements of the country’s economic and social development. It is not possible to expropriate property except in cases and in accordance with the procedures stipulated by law.

However, the Moroccan legislator framed this right of foreign ownership of real estate, and made

it a non-absolute right, but made it subject to a set of texts that frame it and subject it to a set of special legal texts that limit its scope and limit a set of procedures related to its acquisition.

  • Does the nationality of the foreigner constitute some differences in the legal procedure?

 

Foreign nationality does not play a role in owning real estate in Morocco. With regard to real

estate located within the urban area, all foreigners from different countries whose sovereignty is recognized by the Kingdom of Morocco in accordance with international law can own real estate

without restrictions.

But with regard to real estate located within the rural area, foreigners do not have the right to

own real estate, regardless of their nationality.
